{"id":2044,"date":"2015-08-18T10:29:06","date_gmt":"2015-08-18T08:29:06","guid":{"rendered":"http:\/\/www.forumclubhandball.com\/?p=2044"},"modified":"2015-08-18T10:29:06","modified_gmt":"2015-08-18T08:29:06","slug":"27-7-2015-17-bundesliga-clubs-lost-the-2nd-instance-in-the-court-case-against-ihfdhb","status":"publish","type":"post","link":"http:\/\/www.forumclubhandball.com\/?p=2044","title":{"rendered":"27.7.2015: 17 Bundesliga clubs lost the 2nd instance in the court case against IHF\/DHB"},"content":{"rendered":"<p>With the support of FCH, 17 Bundesliga-Clubs won the 1<sup>st<\/sup> instance of the court case against German Handball Federation (DHB) and International Handball Federation (IHF) and lost the 2<sup>nd<\/sup> instance at the high court OLG D\u00fcsseldorf.<\/p>\n<p>After the positive decision of the 1<sup>st<\/sup> instance, the Council of the IHF changed 4 points of the \u2018Regulations for International Transfers\u2019 in favor of the clubs:<\/p>\n<ul>\n<li>The overall release period was limited to 60 days per year (plus Olympic Games).<\/li>\n<li>The overall period for Championships (including preparation period) was limited to 29 days.<\/li>\n<li>The IHF obliged itself to play compensation to the clubs for the release of players to the World Championships.<\/li>\n<li>The IHF obliged itself to provide an insurance of player salaries in favor of the clubs.<\/li>\n<\/ul>\n<p>These changes are positive for the clubs, but:<\/p>\n<ul>\n<li>The amount of compensation, paid to the clubs, is not negotiated or even defined.<\/li>\n<li>The insurance services are limited to 3 months, which is not sufficient in case of severe injury.<\/li>\n<li>All regulations can be changed in the next Council meeting without any influence of the clubs.<\/li>\n<\/ul>\n<p>IHF always has the possibility to change the regulations again, once the trial is over.<\/p>\n<p>The court of the 2<sup>nd<\/sup> instance (the Oberlandesgericht D\u00fcsseldorf) decided that<\/p>\n<ul>\n<li>The case is not admissible due to a lack of legal interest.<\/li>\n<\/ul>\n<ul>\n<li>IHF has changed the regulations effectively.<\/li>\n<li>The statutes of IHF are not a violation of European competition law.<\/li>\n<li>The regulations of the IHF are not harming the competitiveness of the clubs.<\/li>\n<li>The behavior of the IHF is not an abuse of dominant position.<\/li>\n<li>The case is not of general importance.<\/li>\n<li>An appeal against the decision is not permitted.<\/li>\n<\/ul>\n<p>Anyhow it is possible to appeal to the 3<sup>rd<\/sup> instance against the decision of the 2nd instance\u00a0that an appeal is not permitted. In case of a positive decision, the 3<sup>rd<\/sup> instance will deal with the case immediately.<\/p>\n<p>The board of FCH will deal with the case during the next ordinary board meeting on 19\/20<sup>th<\/sup> October and decide whether to proceed with the Trial or not.
